Note I

The Embassy of the Republic of Korea presents its compliments to the Department of Foreign Affairs of Australia and has the honour to refer to the discussions held between the officials of the Government of the Republic of Korea and the Government of Australia concerning the amendment of Articles I and III of the Subsidiary Agreement between the Government of the Republic of Korea and the Government of Australia concerning Squid Jigging by Fishing Vessels of the Republic of Korea, which was signed at Canberra on 28 November 1985.

In accordance with the decision reached between the officials of the two Governments on this matter, the Embassy of the Republic of Korea has the honour to propose that Articles I and III, as amended, shall read as follows:

Article I

Subject to the payment to the Government of Australia of a fee for all the vessels to be licensed of 59,000 Australian dollars, the Government of Australia shall, in accordance with the provisions of the Head Agreement, issue licences for four vessels (hereinafter referred to as "the licensed vessels") for the period of validity of this Subsidiary Agreement.

Article III

1. The Government of Australia shall permit the licensed vessels to take a quantity of squid which except as provided in sub-paragraph 2 of this Article shall not exceed 500 tonnes.

2. The Government of Australia shall permit the licensed vessels to take an additional quantity of squid not exceeding 1,500 tonnes upon:

(a) receiving the written request of the Government of the Republic of Korea specifying the additional quantity of squid to take for which permission is sought; and

(b) payment to the Government of Australia of an additional fee of 118 Australian dollars per tonne of squid.

The Embassy of the Republic of Korea has further the honour to propose that if the foregoing is acceptable to the Government of Australia, this Note and the Department's reply confirming the above shall constitute and evidence an agreement amending Articles I and III of the Subsidiary Agreement between the Government of the Republic of Korea and the Government of Australia concerning Squid Jigging by Fishing Vessels of the Republic of Korea, in the manner stated above, to enter into force on the twenty-first of January 1986.

The Embassy of the Republic of Korea avails itself of this opportunity to renew to the Department of Foreign Affairs the assurances of its highest consideration.

The Department of Foreign Affairs presents its compliments to the Embassy of the Republic of Korea and has the honour to refer to the Embassy's Note No. KAU/PRO/86-8 of 26 February, which reads as follows:

The Department has the honour to inform the Embassy that the foregoing is acceptable to the Government of Australia and to confirm that the Embassy's Note and this confirmatory Note in reply shall together constitute and evidence an agreement on the matter between the Government of Australia and the Government of the Republic of Korea, which shall enter into force on the twenty-first of January 1986.

The Department of Foreign Affairs avails itself of this opportunity to renew to the Embassy of the Republic of Korea the assurances of its highest consideration.
