Amendments to Annexes II, VIII and IX to the Convention On The Control Of Transboundary Movements Of Hazardous Wastes And Their Disposal

Within the period of six months from the date of depositary notification C.N.432.2019.TREATIES-XXVII.3 of 24 September 2019 by which the Secretary-General transmitted to the Governments of the Contracting Parties the text of amendments to Annexes II, VIII and IX to the Convention, three (3) of the Contracting Parties to the Convention (Canada, China and Turkey) notified the Secretary-General, pursuant to article 18 (2) (b) of the Convention, that they are unable to accept the said amendments at the date of their entry into force. Therefore, the amendments to Annexes II, VIII and IX became effective for all Parties to the Convention, with the exception of Canada, China and Turkey, on 24 March 2020, in accordance with paragraphs (2) (c) and (3) of article 18 of the Convention which read as follows: . "2. (c) On the expiry of six months from the date of the circulation of the communication by the Depositary, the annex shall become effective for all Parties to this Convention or to any protocol concerned, which have not submitted a notification in accordance with the provision of subparagraph (b) above. 3. The proposal, adoption and entry into force of amendments to annexes to this Convention or to any protocol shall be subject to the same procedure as for the proposal, adoption and entry into force of annexes to the Convention or annexes to a protocol. Annexes and amendments thereto shall take due account, inter alia, of relevant scientific and technical considerations."
