Decision M(92)3) of the Committee of Ministers of the Benelux Economic Union to set up a Special Committee of Consultation and Advice to draw up a management and development plan for the future cross-border park Zoom-Kalmthoutse Heide

The Committee of Ministers of the Benelux Economic Union, Having regard to Articles 30, 31 and 32 of the Union Treaty ,

Having regard to the Benelux Agreement on Nature Conservation and Landscape Protection, M (81) 4, signed at Brussels on 8 June 1982, and in particular Articles 2, 3 and 4,

Having regard to the Benelux Decision, M (87) 10, signed in Brussels on November 24, 1987, concerning a Belgian-Dutch border park 'Kalmthoutse Heide',

Considering that the establishment of transboundary parks is an important objective of the aforementioned Agreement and is part of applicable international arrangements,

Partly in view of the advice issued by the Dutch Provisional Committee on National Parks and the Report of the Ministry of the Flemish Community,

Has decided the following:

Article 1

For the area 'De Zoom-Kalmthoutse Heide' as delimited on map 2 accompanying this decision , a Special Committee of Consultation and Advice to draw up a management and development plan will be set up.

Article 2

1. The public law bodies involved in the area as well as the land owners / managers are represented in this committee. The chair is held by an independent chair to be appointed by the Committee of Ministers.

2. Within six months after signing this decision, the competent authorities shall notify the Secretary-General of the Benelux Economic Union of its composition. Each of the two delegations consists of a maximum of 10 members who may be assisted by experts.

Article 3

1. Within a period of 2 years, renewable at most by 1 year, the management and development plan is drawn up and submitted to the Committee of Ministers for approval. On the basis of this approved plan, the cross-border park can be established by decision of the Committee of Ministers.

2. The main principles of the advice of the Dutch Provisional Committee on National Parks and the positions of the report of the Ministry of the Flemish Community apply to the preparation of this management and development plan.

Article 4

Pending approval of the management and development plan, the competent authorities shall take the necessary measures to conserve the nature and value of the landscape and nature areas in the area referred to in

Article 5

This Decision shall enter into force on the day of its signature.
