Decision (M(83)27) of the Committee of Ministers of the Benelux Economic Union on the introduction into the nature of non-native animal species

The Committee of Ministers of the Benelux Economic Union,

Having regard to Articles 2 and 4 of the Benelux Agreement on Nature Conservation and Landscape Protection, M (81) 4 signed in Brussels on 8 June 1982 and entered into force on 1 October 1983,

Having regard to Article 8 of the Union Treaty ,

Considering that at the Third Benelux Government Conference on 20 and 21 October 1975, the governments decided to coordinate environmental policy,

Has decided the following,

Article 1

With a view to combating fauna adulteration and the uncontrollable development of non-native animal species, the governments of the Benelux countries will ensure that the introduction into the wild of these animal species is prohibited in every partner country, subject to a permit from the Ministers. , responsible for the protection and management of fauna and flora.

Article 2

The governments of the Benelux countries will ensure that the permit referred to in Article 1 is only granted after a thorough investigation has taken place of the impact of the introduction into the nature of the said animal species on the native fauna and biotic communities and an insight has been gained into their chances of spreading in adjacent areas.

They ensure that the introduction into nature of non-indigenous animal species does not adversely affect the local fauna and flora.

Article 3

The governments of the Benelux countries will consult in advance with regard to the licensing policy and exchange the research results referred to in Article 2.

The consultation and the exchange of information as referred to in this article takes place within the framework of the Special Commission for the Environment, Section 'Nature Conservation and Landscape Protection'.

Article 4

a)This Decision shall enter into force on the date of signature.

b)Within six months from that date, governments shall report to the Committee of Ministers on the measures taken to implement this Decision. The text of the national implementing measures will be attached to this report.
