AGREEMENT
between the Government of the Russian Federation and the Government of the Socialist Republic of Vietnam
on cooperation in the field of quarantine and plant protection
The Government of the Russian Federation and the Government of the Socialist Republic of Viet Nam, hereinafter referred to as the Contracting Parties, guided by the desire to contribute to further deepening cooperation in the field of quarantine and plant protection, in order to improve the protection of their territories from taxon-quarantine and other dangerous organisms and reduce losses caused by them, and development of trade and exchange between the two countries of plants and plant products have agreed on the following:
Article 1
The competent authorities for the implementation of this Agreement are: from the Russian Party - the Ministry of Agriculture of the Russian Federation,
from the Vietnamese Party - the Ministry of Agriculture and Rural Development of the Socialist Republic of Vietnam.
Article 2
Under the quarantine and other dangerous organisms in this Agreement pests are understood, excrete gels of plant diseases and weeds according to the lists according to annexes 1 and 2.
The competent authorities of the Contracting Parties may, in the future, modify or supplement these lists.
These changes or additions will be notified to the competent authorities of the other Contracting Party and will enter into force 60 days after the receipt of the notification thereof.
Article 3
In order to develop regular cooperation on quarantine and plant protection issues, the Contracting Parties will:
1) take the necessary measures to prevent the spread of quarantine and other dangerous organisms from the territory of the State of one Contracting Party to the territory of the State of the other Contracting Party when importing and exporting seeds, planting stock, plants and plant products (hereinafter referred to as "quarantine cargo");
2) comply with phytosanitary regulations in force in the territory of the states of the Contracting Parties when exporting, importing and transiting regulated articles;
3) to exchange rules, regulations and instructions that regulate phytosanitary control of quarantine cargo during import, export and transit within 2 months from the date of their publication;
4) exchange information on scientific research works and publications, special literature in the field of quarantine and plant protection;
5) to exchange specialists for studying the achievements of science and practice in the field of quarantine and plant protection;
6) To provide each other with scientific, technical and other assistance in quarantine and plant protection;
7) to carry out joint quarantine inspection of lots of regulated cargoes in case of export and import, if necessary, with the consent of the Contracting Parties.
Article 4
The competent authorities of the Contracting Parties undertake to exchange information for the past year regarding the detection and dissemination of quarantine organisms, as well as measures to combat them, before April 1, each year. If new or especially dangerous pests are discovered, the exchange of information should be carried out immediately.
Article 5
The Contracting Parties undertake to take all measures to prevent penetration from the territory of one country into the territory of another country with quarantine pests and other dangerous organisms exported under quarantine cargo in accordance with the current legislation on quarantine and plant protection of the importing country.
Each consignment of quarantine cargo imported from the territory of the State of one Contracting Party to the territory of the State of the other Contracting Party shall be accompanied by a phytosanitary certificate of the exporting country's quarantine and plant protection service.
Each consignment of quarantine cargo that is transported through the territory of the State of one Contracting Party to the territory of the State of the other Contracting Party shall also be accompanied by a phytosanitary certificate.
The competent authorities of the Contracting Parties reserve the right to set additional conditions for the phytosanitary status of these parties when concluding a contract for the purchase of certain batches.
Article 6
Export, import and transit of quarantine cargo from the territory of the State of one Contracting Party to the territory of the State of the other Contracting Party will be carried out through border points determined by the quarantine and plant protection service of the importing country.
Article 7
Vehicles, including containers and packagings used to transport regulated articles to the territory of the State of the other Contracting Party, shall be cleared of quarantine organisms at any stage of development. Before loading quarantine cargo, vehicles must be inspected by representatives of the quarantine and plant protection service of the exporting country and measures are taken to prevent the contamination of regulated articles by dangerous organisms during loading and en route.
In the case of infection with quarantine organisms, vehicles must be decontaminated.
Article 8
As a packaging material for exported goods, the Contracting Parties will use paper. plastic, and also materials of synthetic manufacture which can not be carriers of quarantine organisms and should be free from soil.
Soil and peat will not be used for this purpose. Straw, hay and other plant materials can only be used after disinfection.
Article 9
The competent authorities of the Contracting Parties retain the right to carry out phytosanitary control of imported quarantine cargo and have the right to take quarantine measures provided for by the rules of the Contracting Party to whose territory they are imported.
If, during the import of regulated articles, the competent authorities of one of the Contracting Parties determine that a party that is infected by quarantine pests and other dangerous organisms shall be returned. disinfection or destruction, this shall be reported immediately in writing to the competent authorities of the other Contracting Party. The message sent to the quarantine and plant protection service of the exporting country should indicate the type of quarantine facility that the given lot is infected with.
Article 10
Phytosanitary requirements do not apply to agricultural products of plant origin that have undergone industrial processing, as a result of which pests, pathogens of plants and weeds are destroyed, with the exception of products that are prone to infection during storage.
Article 11
Vegetable consignments intended for consulates, diplomatic and other representations of both Contracting Parties shall also be subject to the provisions of this Agreement, even if these plants and plant products are included in consignments containing other products and goods.
Article 12
The competent authorities of the Contracting Parties shall convene meetings as necessary, at least once every two years, to resolve practical issues related to the implementation of this Agreement, as well as to discuss scientific research and exchange of experiences in the field of quarantine and plant protection.
To resolve issues related to the implementation of activities provided for in this Agreement, the competent authorities of the Contracting Parties may at any time enter into direct contacts.
The place, time and program of meetings and meetings are established on the basis of mutual agreement.
Organizational expenses for holding meetings or extraordinary meetings shall be borne by the Contracting Party in whose territory the said measure is held. The costs associated with sending participants to meetings or meetings (the contents and travel to and from the meeting place) are borne by the visiting Contracting Party.
Article 13
The provisions of this Agreement shall not affect the rights and obligations of the Contracting Parties arising from previously concluded treaties, as well as from membership in international organizations on plant quarantine and protection.
Article 14
This Agreement may be amended or supplemented by a written agreement signed by each of the Contracting Parties.
Article 15
This Agreement shall enter into force 30 days after the date of the last notification of the execution of legal procedures necessary for the entry into force of this Agreement.
This Agreement will be valid for 5 (five) years and automatically renewed for subsequent five-year periods unless either of the Contracting Parties makes a written application to the other Contracting Party of its intention to terminate the Agreement no later than 6 months before the expiration of the relevant period.
The termination of this Agreement will not affect the fulfillment of the obligations of each Contracting Party arising from contracts or contracts concluded during the period of its operation.
