Agreement Between the Government of the Republic of Uzbekistan and the Government of the Republic of Tajikistan on Cooperation in the Area of Rational Water and Energy Uses in 2000

The Government of the Republic of Uzbekistan and the Government of the Republic of Tajikistan hereinafter referred to as the Parties

In an effort to further develop bilateral mutual advantageous cooperation in the electric power area and carry on an auspicious vegetation flooding campaign in the Syr Darya midstream in 1999

The Parties agreed as follows:

Article 1

The Tajik Party shall ensure by 31 May 2000 the Kairakkum water storage of 3,418 million m3 with the normal banked-up level of 347.50, and during the summer months shall set the following amounts of water releases, with daily water discharges fixed at the hydro control station Kzylkishlak:

June 500 m3s

July 650 m3s

August 600 m3s

September 300 m3s

The Kairakkum operation mode is updated by BVO Syr Darya in view of the Syr Darya basin water conditions.

Article 2

To ensure the Kairakkum storage and electricity transfers to the Tajik energy system the Uzbek Party shall transfer 200 million kWh of electricity to the Republic of Tajikistan, including:

March: 100 million kWh;

April: 100 million kWh;

And will continue treatment works for the chute delivering water to the pump station Makhram. Article 3

The Tajik Party shall transfer 350 million kWh of the electric power to the Republic of Uzbekistan in June-September 2000, including:

In June 105 million kWh;

In July 105 million kWh;

In August 105 million kWh;

In September 35 million kWh;

Article 4

Terms, electricity transfer tariffs, and electricity transit and frequency regulation services will be provided based on the Agreement between the Uzbek Ministry of Energy and Electrification and Tajik SSHC Barki Tochik on mutual electricity transfers and services for the electricity transit and frequency regulation in 2000. The electricity transfer tariff is set compliant to Articles 2 and 3 of the Agreement:

- From the Republic of Uzbekistan to the Republic of Tajikistan - 2,5 cents per 1 kWh (VAT included);

- From the Republic of Tajikistan to the Republic of Uzbekistan - 1,429 cents per 1 kWh (VAT included).

Article 5

The Parties agreed that the balance of mutual settlements may be recovered by the supplies of material and technical resources, and energy products (works, services), necessary for normal functioning of the energy systems.

Article 6

The Parties agreed that the products (works and services) provided within the Agreement shall be free of all types of export and import customs payments.

Article 7

Given the mutual consent of the Parties, amendments and addenda can be introduced and formalized by separate protocols, and will become integral parts of the Agreement.

Article 8

Any disputes or disagreements regarding the Agreement elucidation or applications will be resolved through negotiations.

Article 9

The Agreement shall be in force from the signature date, and be the base document for mutual settlements of the legal entities of the Parties in 1999-2000.

Performed in Dushanbe, January 14, 2000, in two copes in Russian, both texts have equal validity.
