THE FEDERAL REPUBLIC OF GERMANY,

THE KINGDOM OF BELGIUM,

THE FRENCH REPUBLIC,

THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND,

THE KINGDOM OF THE NETHERLANDS,

THE SWISS CONFEDERATION,

Whereas certain difficulties have arisen in the application and interpretation of certain articles of the Revised Convention for Rhine Navigation of 17 October 1868, as amended on 20 November 1963 (hereinafter referred to as "the Convention"),

And whereas the Additional Protocol to the Convention for Rhine Navigation of 17 October 1868 signed on 18 September 1895 at Mannheim no longer fully takes into account changes in the law enforcement system in the various Contracting States and therefore requires to be adapted to the new circumstances, particularly by empowering the administrative authorities to punish breaches of the navigation regulations enacted by mutual agreement;

Have agreed on the following:

Article I shall be included in Article 40 bis of the Convention,

ARTICLE II

The Contracting States shall exchange information, through the Secretary-General of the Central Commission for the Navigation of the Rhine, on the legal and regulatory provisions they adopt in implementation of this protocol.

ARTICLE III

The Additional Protocol signed at Mannheim on 18 September 1895 to the Revised Convention for Rhine Navigation of 17 October 1868 shall be abrogated on the date on which the present Additional Protocol enters into force.

ARTICLE IV

This Additional Protocol shall be subject to ratification.

The instruments of ratification shall be deposited with the Secretariat of the Central Commission for preservation in its archives.

A report on the deposit of the instruments of ratification shall be made by the Secretary-General who shall transmit to each of the signatory States a certified true copy of the instruments of ratification together with the report of deposit.

ARTICLE V

This Additional Protocol shall enter into force on the day following the deposit of the sixth instrument of ratification with the Secretariat of the Central Commission; the Secretariat shall inform the other signatory States thereof.

ARTICLE VI

This Additional Protocol, done in a single copy in German, in French and in Dutch, the French text being authentic in case of divergences, shall remain deposited in the archives of the Central Commission.

A copy certified as true by the Secretary-General shall be transmitted to each of the Contracting States.

IN WITNESS WHEREOF, the undersigned, having deposited their full powers, having signed this Additional Protocol.
