1996 PROTOCOL

1. A Delegation of the European Community headed by Mr. Ole TOUGAARD, a Delegation of the Faroe Islands headed by Mr. Kaj P. MORTENSEN, a Delegation of Iceland headed by Mr. Johann SIGURJÓNSSON, a Delegation of Norway headed by Mr. Dag Erling STAI and a Delegation of the Russian Federation, headed by Dr. Vjacheslav K. ZILANOV met in Oslo from 12 - 14 December 1996 to consult on the management of the Norwegian Spring Spawning Herring (Atlanto-Scandian Herring) stock for 1997. The meeting was a continuation of a previous meeting held in London 18 -19 November 1996.

2. The Heads of Delegations agreed to recommend to their respective authorities the arrangements for the regulation of the Norwegian Spring Spawning Herring (Atlanto-Scandian Herring) stock in 1997 set out in the Annex to this Agreed Record.

3. This Agreed Record, including the bilateral arrangements related to the implementation of this Agreed Record, shall be applied provisionally from 1 January 1997 and enter into force when all Parties have notified each other of the completion of their necessary procedures.

Done at Oslo on 14 December 1996 in five originals in English. The Parties shall agree on official texts of this Agreed Record in English, Faroese, Icelandic, Norwegian and Russian.

ANNEX

1. The Parties agreed to take as a basis a TAC (total allowable catch) for the Norwegian Spring Spawning Herring (Atlanto-Scandian Herring) stock, hereinafter referred to as herring, of 1,500,000 tonnes in 1997.

2. In keeping with the above, the Parties agreed to restrict their fishing on the herring stock in 1997 to a maximum limit of 1,498,000 tonnes on the basis of the following quotas:

The European Community 125,000 tonnes* The Faroe Islands and Iceland 315,000 tonnes* Norway 854,000 tonnes The Russian Federation 204,000 tonnes

3. Further arrangements, including arrangements for access and other conditions for fishing in the respective zones of fisheries jurisdiction of the Parties, are regulated by bilateral arrangements.

*Within the bilateral arrangements, the Faroe Islands and the European Community will exchange 5,000 tonnes.

Arrangement between Iceland and Norway

Arrangement between Iceland and Norway on access to the Icelandic Economic Zone and the Norwegian Economic Zone and the Fishery Zone around Jan Mayen in 1997

In accordance with paragraph 3 of the Annex to Agreed Record dated 14 December 1996 of conclusions of fisheries consultations between the European Community, the Faroe Islands, Iceland, Norway and the Russian Federation on the management of the Norwegian spring Spawning Herring (Atlanto Scandian Herring) Stock in the Northeast Atlantic for 1997, separate bilateral arrangements on access to the respective zones of fisheries jurisdiction of the Parties have been concluded.

The following arrangement between Iceland and Norway shall apply:

Icelandic fishing vessels are granted access in 1997 to fish 233,000 tonnes of herring in the Fishery Zone around San Mayen or in the Norwegian Economic Zone north of 62oN of which a maximum of 10,000 tonnes of herring may be fished in the Norwegian Economic Zone north of 62oN.

Norwegian fishing vessels are granted access in 1997 to fish 166,000 tonnes of herring in the Icelandic Economic Zone.

The Parties will agree upon further provisions on the conditions of the fisheries.

Arrangement between Norway and the European Community

With reference to Agreed Record of conclusions of Fisheries Consultations on the Management of the Norwegian Spring Spawning Herring (Atlanto-Scandian Herring) stock in the North-East Atlantic for 1997 between the European Community, the Faroe Islands, Iceland, Norway and the Russian Federation of 14 December 1996, separate bilateral arrangements on access to the respective zones of fisheries jurisdiction of the Parties have been concluded.

The following arrangement between Norway and the European Community will be applied:

Within the framework of the above five party arrangement the European Community is granted access to fish 37,000 tonnes of herring in the Norwegian Economic Zone north of 62oN or in the Fishery Zone around Jan Mayen, of which a maximum of 30,000 tonnes may be fished in the Norwegian Economic Zone north of 62oN.

Norway is granted access to fish 10,000 tonnes of herring in Community fishing waters north of 62oN.

Specific conditions pertaining to the conduct of this fishery are to be agreed upon at a later stage.

Arrangement between Norway and the Russian Federation

With reference to Agreed Record of conclusions of Fisheries Consultations on the Management of the Norwegian Spring Spawning Herring (Atlanto-Scandian Herring) stock in the North-East Atlantic for 1997 between the European Community, the Faroe Islands, Iceland, Norway and the Russian Federation of 14 December 1996, separate bilateral arrangements on access to the respective zones of fisheries jurisdiction of the Parties have been concluded.

The following arrangement between Norway and the Russian Federation will be applied:

Within the framework of the above five party arrangement the Russian Federation is granted access to fish 150,000 tonnes of herring in the Norwegian Economic Zone north of62oN and 12,000 tonnes of herring in the areas outside the territorial waters in the Fisheries Zone around Jan Mayen.

The Russian Federation shall transfer 2,500 tonnes of its herring quota to Norway.

Specific conditions pertaining to the conduct of this fishery are to be agreed upon at a later stage.

Arrangement between Norway and the Faroe Islands

With reference to Agreed Record of conclusions of Fisheries Consultations on the Management of the Norwegian Spring Spawning Herring (Atlanto-Scandian Herring) stock in the North-East Atlantic for 1997 between the European Community, the Faroe Islands, Iceland, Norway and the Russian Federation of 14 December 1996, separate bilateral arrangements on access to the respective zones of fisheries jurisdiction of the Parties have been concluded.

The following arrangement between Norway and the Faroe Islands will be applied:

Within the framework of the above five party arrangement the Faroe Islands is granted access to fish 37,000 tonnes of herring in the Norwegian Economic Zone north of 62oN or in the Fishery Zone around Jan Mayen, of which a maximum of 30,000 tonnes may be fished in the Norwegian Economic Zone north of 62oN.

Norway is granted access to fish 37,000 tonnes of herring in Faroese Fisheries Zone.

Specific conditions pertaining to the conduct of this fishery are to be agreed upon at later stage.

UNDERSTANDING on Special Conservation Measures with Respect to Management of the Norwegian Spring Spawning Herring (Atlanto-Scandian) herring Stock in 1997

With reference to Article 2.1. of the PROTOCOL on the Conservation, Rational Utilisation and Management of Norwegian Spring Spawning Herring (Atlanto-Scandian Herring) in the Northeast Atlantic and with reference to the Agreed Record of Conclusions of Fisheries Consultations on the Management of the Norwegian Spring Spawning (Atlanto-Scandian herring) Stock in the Northeast Atlantic for 1997 signed today.

The Russian Federation shall reserve for conservation purposes 12,000 tons of its quota for 1997 in its Exclusive Economic Zone in the Barents Sea.
