AGREEMENT ON MARINE FISHERIES BETWEEN THE GOVERNMENT OF THE KINGDOM OF MOROCCO AND THE GOVERNMENT OF JAPAN

The Government of the Government of Kingdom of Morocco and the Government of Japan.

Considering their common concern for the rational management, conservation and optimum utilization of the fishery resources of the sea.

Taking into account the adoption of the United Nations Convention on the Law of the Sea,

Recognizing that the Government of the Kingdom of Morocco exercises, in accordance with international law, jurisdiction over the living resources in its adjacent waters within a zone of 200 nautical miles (hereinafter referred to as "the Moroccan waters"), and

Wishing to develop mutually beneficial cooperation in the field of marine fisheries and in this way to strength then the friendly relations existing between the Kingdom of Morocco and Japan,

Have agreed as follows:

ARTICLE 1

The Government of the Kingdom of Morocco and the Government of Japan undertake to ensure close cooperation between the two countries in the field of marine fisheries.

ARTICLE 2

1. The Government of the Kingdom of Morocco undertakes to permit fishing vessels of Japan to fish within the Moroccan waters in accordance with the relevant laws and regulations of the Kingdom of Morocco.

2. The Government of the Kingdom of Morocco shall determine, on the basis of the best available scientific evidence, the allocations of parts of total allowable catches surplus to harvesting capacity of Moroccan fishing vessels and. the other terms and conditions concerning fishing activities of fishing vessels of Japan within the Moroccan waters.

3. The Government of the Kingdom of Morocco shall notify the Government of Japan of the determination refers to in paragraphe 2 of this Article on a timely basis.

ARTICLE 3

The Government of the Kingdom of Morocco shall issue licenses, in accordance with the relevant laws and regulations of the Kingdom of Morocco, to enable fishing vessels of Japan to engage in fishing within the Morocco waters.

ARTICLE 4

The Government of Japan shall take necessary measures to ensure, in accordance with the relevant laws and regulations of Japan:

that fishing vessels of Japan unless licensed by the Government of Kingdom of Morocco shall not engage in fishing within the Moroccan waters ; and that nationals and fishing vessels of Japan engaging in fishing under this Agreement shall comply with the provisions of this Agreement and with the terms and conditions of licenses issued by the Government of the Kingdom of Morocco.

ARTICLE 5

The Government of the Kingdom of Morocco and the Government of Japan shall jointly examine appropriate arrangements to encourage fishing vessels of Japan to use Moroccan ports to ship or discharge crew members and for such other purposes as may be agreed upon.

ARTICLE 6

In cases of seizure by the authorities of the Kingdom of Morocco of fishing vessels of Japan engaging in fishing under this Agreement, the Government of Japan will be promptly notified of the action taken through diplomatic channels.

ARTICLE 7

1. The Government of the Kingdom of Morocco and the Government of Japan shall carry out consultations annually regarding the implementation of this Agreement including the determination of the detailed terms and conditions concerning fishing activities o fishing vessels of Japan within the Moroccan waters.

2. The Government of the Kingdom of Morocco and the Government of Japan shall jointly examine, as appropriate light of the development of fisheries relations between two countries pursuant to the provisions of this Agreement the possibility of expanded bilateral cooperation, including future cooperation on such matters as exchanges of technical information and personnel, training, transfer of technological and facilitation of cooperative arrangements between Moroccan and Japanese enterprises with respect to utilization of fishery resources.

ARTICLE 8

Nothing in this Agreement shall be deemed to prejudice the views or positions of either Government in respect to any question of the law of the sea related to the United Nations Convention on the Law of the Sea.

ARTICLE 9

1 This Agreement shall enter into force on the day of receipt by the Government of Japan of the written notification from the Government of the Kingdom of Morocco on the completion of internal legal procedures for the entering into force of this Agreement

2. This Agreement shall remain in force for a period of one year and shall continue in force thereafter until the expiration of six months from the day on which either Government shall give written notice of its intention to terminate this Agreement.

this Agreement.
