Art.11.1 1. No provision in this Agreement shall prejudice in any manner whatsoever the sovereignty of States over their territorial waters, or the jurisdiction and sovereign rights which they exercise in their exclusive economic zones and over the continental shelf pursuant to international law, or the exercise by vessels and aircraft of all States of the rights and freedom of navigation as governed by international law and in accordance with the relevant international instruments.
Art.11.2 2. Under no circumstances may the division into areas referred to in Articles 8 and 9 of this Agreement be invoked as a precedent or as an argument in respect of sovereignty or jurisdiction.
Art.14.1 1. Article 13 of this Agreement may not in any circumstances be interpreted as prejudicing the rights of the Parties to recover from third parties the costs involved in actions undertaken to deal with pollution or a threat of pollution pursuant to other provisions and rules applicable under national and international law.
