Art.16 Article 16
Art.16.1 1. The Parties agree to develop and maintain, with the assistance of competent global, regional and subregional organisations as requested, technical guidelines and legislation giving adequate emphasis to environmental and social factors to facilitate balanced development of their natural resources and planning of their major projects which might affect the marine environment in such a way as to prevent or minimise harmful impacts on the Convention Area.
Art.16.2 2. Each Party shall, within its capabilities, assess the potential effects of such projects on the marine environment, so that appropriate measures can be taken to prevent any substantial pollution of, or significant and harmful changes within, the Convention Area.
Art.16.3 3. With respect to the assessment referred to in paragraph 2, each Party shall, where appropriate, invite:
Art.16.3.a (a) public comment according to its national procedures;
Art.16.3.b (b) other Parties that may be affected to consult with it and submit comments.
Art.16.4x The results of these assessments shall be communicated to the Organisation, which shall make them available to interested Parties.
Art.21 Article 21
Art.21.1 1. The Organisation shall be responsible for carrying out the following secretariat functions:
Art.21.1.a (a) to prepare and convene the meetings of Parties;
Art.21.1.b (b) to transmit to the Parties notifications, reports and other information received in accordance with this Convention and its Protocols;
Art.21.1.c (c) to perform the functions assigned to it by the Protocols to this Convention;
Art.21.1.d (d) to consider enquiries by, and information from, the Parties and to consult with them on questions relating to this Convention and the Protocols;
Art.21.1.e (e) to co-ordinate the implementation of cooperative activities agreed upon by the Parties;
Art.21.1.f (f) to ensure the necessary co-ordination with other competent global, regional and sub-regional bodies;
Art.21.1.g (g) to enter into such administrative arrangements as may be required for the effective discharge of the secretariat functions;
Art.21.1.h (h) to perform such other functions as may be assigned to it by the Parties; and
Art.21.1.i (i) to transmit to the South Pacific Conference and the South Pacific Forum the reports of ordinary and extraordinary meetings of the Parties.
Art.21.2 2. Each Party shall designate an appropriate national authority to serve as the channel of communication with the Organisation for the purposes of this Convention.
